Terms of Service

1. Introduction

Welcome to FormWise ("we", "our", or "us"). These Terms of Service ("Terms") govern your use of our form backend service, including our website, API, SDK, and all related services (collectively, the "Service").

By accessing or using FormWise, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Account Terms

Account Creation: You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account and API keys.

Authentication: FormWise uses OAuth (Google, GitHub) and magic link authentication. You are responsible for maintaining the confidentiality of your authentication credentials.

Eligibility: You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

Account Responsibility: You are responsible for all activity that occurs under your account, including submissions made using your API keys.

3. Service Plans & Billing

Free Tier: Includes 30 submissions per month, 5-day data retention, and up to 2 API keys. No credit card required.

Paid Plans: Starter (€9/month) and Pro (€29/month) plans offer increased submission limits, longer retention periods, and additional API keys.

Billing: Paid subscriptions are billed monthly in advance via Stripe. All fees are non-refundable except as required by law.

Quota Limits: Legitimate form submissions count toward your monthly quota. Spam submissions do not count toward your quota. Exceeding your quota will prevent new submissions until the next billing cycle or upgrade.

Cancellation: You may cancel your subscription at any time. Your service will continue until the end of your current billing period. After cancellation, your account will be downgraded to the free tier.

Plan Changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the end of your current billing period.

4. API Usage & Restrictions

API Keys: You may generate multiple API keys per your plan limits. Each key can be labeled and configured independently. API keys must be kept confidential and are shown only once upon creation.

Rate Limits: API usage is subject to rate limits (100 requests per hour per key, 500 requests per hour per IP address). Excessive use may result in temporary throttling or account suspension.

Acceptable Use: You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to bypass rate limits or other restrictions
  • Submit malicious content, spam, or harmful code
  • Impersonate others or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Share or resell your API keys or account access
  • Reverse engineer or attempt to extract source code
  • Use the Service to collect or harvest personal information without consent

5. Data & Content

Your Data: You retain all rights to the form submissions and data you collect through FormWise. We do not claim ownership of your content.

Data Retention: Submission data is retained according to your plan:

  • Free tier: 5 days
  • Starter tier: 30 days
  • Pro tier: 90 days
  • Enterprise: Custom retention periods

After the retention period, data is automatically and permanently deleted. We are not responsible for data loss after the retention period expires.

Data Processing: We process form submissions to provide spam detection, email forwarding, and analytics. All processing is performed in accordance with our Privacy Policy.

Content Responsibility: You are solely responsible for the content submitted through your forms. We reserve the right to remove content that violates these Terms or applicable laws.

6. Spam Detection

FormWise includes AI-powered spam detection via GPT-4 with rule-based fallback mechanisms. While we strive for accuracy, spam detection is not perfect.

False Positives: Legitimate submissions may occasionally be flagged as spam. You should regularly review your spam folder in the dashboard.

Spam Does Not Count Toward Quota: Submissions flagged as spam do not count toward your monthly submission quota.

Spam Detection Limits: Free tier accounts are limited to 30 spam detections per month. Once this limit is reached, additional spam submissions will be rejected. Paid plans include unlimited spam detection.

Spam Retention:All spam submissions are automatically and permanently deleted after 30 days, regardless of your plan's retention period. This allows you time to review and recover any false positives.

7. Service Availability & Support

Uptime: We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

Support: Support is provided via email for all users. Response times vary by plan tier. Enterprise customers receive priority support.

Service Changes:We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice. We will provide at least 30 days' notice for material changes affecting paid plans.

8. Termination

By You: You may terminate your account at any time through your dashboard settings or by contacting support.

By Us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in fraudulent or abusive behavior.

Effect of Termination: Upon termination, your access to the Service will cease immediately. Data beyond the retention period or in terminated accounts will be deleted according to our data retention policy.

9. Disclaimers & Limitations

AS-IS Service:THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee: We do not guarantee that the Service will be error-free, secure, or uninterrupted, or that defects will be corrected.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMWISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Maximum Liability: Our total liability to you for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless FormWise, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content submitted through your forms

11. Governing Law & Disputes

These Terms are governed by the laws of Belgium without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with Belgian law.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
